411. Expande= d Food and Nutrition Education Program

Summary<= /o:p>

Changes the funding formula for EFNEP to include the= 1890 and Insular Area institutions, provide $100,00= 0 in funding to each eligible EFNEP institution, and to provide 3 percent of t= he poverty Census based funding to the 1890 institutions. Specifies that the EFNEP poverty Census based funding be provided directly to 1862, 1890, and insular area institutions, as opposed to being allocated to the States, as under curre= nt law. Provides that if any E= FNEP payment allocation is calculated to be less than $100,000, the Secretary shall adjust EFNEP payment allocations so that each eligible institution receives a payment of not less than $100,000 for that fiscal year. Increases the authorized funding= from $83 million to $90 million per year.

SEC. 411. EXPANDED FOOD AND NUTRITION EDUCATION PROGRAM.

&n= bsp; (a) FUNDING TO 1862, 1890, AND INSULAR AREA INSTITUTIONS.—Section 1425(c)(2)(B) of the National Agriculture Research, Extension, and Teachi= ng Policy Act of 1977 (7 U.S.C. 3175(c)(2)(B)) is amended—<= /span>

(1) in the prefatory material by striking “among the States”;=

(2) by striki= ng clause (i) and inserting the following:<= /o:p>

“(i) $100,000 shall be distributed to each of the land grant colleges and universities (including the University of the District of Columbia and the appropr= iate institution in each of the insular areas);”;

= ; (3) by redesignating clause (ii) as clause (iii);=

(4) by inserting after clau= se (i) the following:

“(ii) 3 percent of the remainder shall be allocated to each 1890 Institution (as defined in section 2 of the Agricultural Research, Extension, and Educati= on Reform Act of 1998) in an amount that bears the same ratio to the total amount to be allocated under this clause as the population of the State living at or below 125 percent of the income poverty guidelines prescribe= d by the Office of Management and Budget (adjusted pursuant to section 673(2) = of the Omnibus Budget Reconciliation Act of 1981 (42 U.S.C. 9902)), bears to= the total population of all the States that have 1890 Institutions living at = or below 125 percent of the income poverty guidelines, as determined by the = last preceding decennial census at the time each such additional amount is fir= st appropriated; and”; and

(5) by amending clause (iii= ), as redesignated, by striking “allocated to each State” and inserting “allocated to the institution eligible to receive funds under the Act of July 2, 1862 (including the appropriate insular area institution) in each State”.

(b) AUTHORIZATION.—Se= ction 1425(c)(3) of the National Agriculture Researc= h, Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3175(c)(3)) is amend= ed by striking “$83,000,000 for each of fiscal years 1996 though 2007” and inserting “$90,000,000 for each of fiscal years 2008 through 2014”.

(c) MINIMUM ALLOCATION.R= 12;Section 1425 of the National Agriculture Research, Extension, and Teaching Policy= Act of 1977 (7 U.S.C. 3175) is amended by adding at the end the following:

“(d) ADJUSTMENTS.— If the payment allocation determined pursua= nt to subsection (c) for any institution eligible under section 3(d) of the Smith-Lever Act (7 U.S.C. 343) would be less than $100,000 for any fiscal year, the Secretary shall adjust payment allocations under subsection (c)= so that each institution eligible under section 3(d) of the Smith-Lever Act = (7 U.S.C. 343) receives a payment of not less than $100,000 for that fiscal year.”.

(d) EFFECTIVE DATE.—The amendments made by this section take effect on October 1, 2007
